BHARAT BANDH, 9 AUGUST

The government is ready to amend the SC/ST act. The central government of the country is likely to introduce the bill for amendment procedures. The bill is likely to pass during the ongoing sessions of Parliament.

The government is almost set to bring amendments to the bill,  and the Dalit MPs of NDA were continuously pressurizing the government for it. The government also has appealed to the Dalit associations to not to follow the schedule of ‘Bandh’, which was their plan to do on the 9th of August.

Recently, Chirag Paswan, a member of Lok Janshakti party and has demanded to dismiss the retired Justice, Adarsh Kumar Goyal. Chirag Paswan argument that the retired Justice, Adarsh Kumar Goyal has debilitated the SC/ST act.

Allegedly, he said that the government has rewarded him by making him the chairman of the NGT. He denied wit the step taken by the government. Along with this, he also demanded of the restoration of the SC/ST Act by taking audience pole. Further, he addressed the government of the upcoming movement by all the Dalit organizations, on the of August.

The Supreme Court has amended the law a few months earlier in March. But the Dalit leaders and organizations were not satisfied with that. They were saying that these amendments have made the law weaker than earlier and totally

SC AND ST Act is the ‘Schedule Cast and Schedule Tribe Act( relief from atrocities), 1989’. The act states that, if there is any type of atrocity or harm causes to these casts then the investigation could be only held and lead by the officer of Inspector rank.

Along with this, the law has a provision of immediate arrestation and to not accept the anticipatory bail. Only the High  Court is responsible for the regular bail. Not only this but the hearings of these cases are set to be done n the special courts.

But according to the amendments made earlier, the arrestation of government employees in these cases would be done only under the able and responsible authority. And for those who are not serving as the government employee, those accused people would be arrested after the SSP sanction.

According to the new guidelines, if there any case comes regarding SC/ST exploitation then a DSP rank holder officer can only lead and investigate. And the investigation period is limited to 7days only. After all these procedures, the DSP is now responsible to clarify whether the case is actually real or the accused is only getting trapped.

Due to these amendments, a new one included is that the government officials could apply for anticipatory bail. According to the Supreme Court, the one who violates the procedure or makes any hurdle or obstacle in between, then he has to face the Court proceedings along with the departmental proceedings.
