The Supreme Court Adjourns Hearing Petition Regarding Article 35A

The Supreme Court has postponed the hearing Petition to 27th August. The petition is regarding with Article 35A which provides Jammu and Kashmir a different honor. This makes the state independence along with their own rules and regulations.
The Apex Court will decide on 27th August. The decision will concern the assignment of the Jammu and Kashmir matter to the Constitution bench or not. The hearing was expected on August 6, Monday. The state, Jammu, and Kashmir are too much affected with this matter that they have created a ‘Bandh’ situation in the state.
They are continued with the on-going protest. According to the official statements, The constitution will decide only one thing, whether the matter should go to the Constitution bench or not’. The main question behind the 35A article is that whether the article 35A is as per the constitution or not. So, being a constitutional matter it must be decided by the bench of judges.
The court has clearly said that it has not much concern with the election procedures or with the protest as well. Rather than that, Article 35A is the constitutional matter so we have to fix that up. Our primary concern is the validity of the Article. Along with this, the court added that it would decide whether the basic structure is working well or not.”
WHAT IS ARTICLE 35A MATTER IS?
It generally comes in mind that ‘what is Article 35A and why the protests are being held on the daily basis in Jammu and Kashmir?
As the Article 35A provides Jammu and Kashmir state to be an independent state. But the state is in the state of protest. Each and every single man and woman have landed on the roads for protest. It has likely taken place as a movement. The reason behind the stressful atmosphere in the state is, Article 35A.
The Article 35A where provides the state to be independent at a side, same on the other side it provides a lot of perks to them. The outsiders cannot get government jobs, here in the state. A question is raising about the special treating facility to the state.
The petitioners have said that this Article was added in the Constitution of India via President confirmation but there was no consultation process happened in the Parliament. There are 4 petitioners, who have filed the petitions and they are,
- the very first petition was from, ‘We The Citizen’
- the second was from ‘West Pakistan Refugee Action Committee’
- another was from, Charu Wali
- and the 4th one has filled by Seema Rajdaan Bhargav’
The postponed hearing will be updated on the 27th of August, 2018.
